1. Acceptance of Terms
These Terms and Conditions govern your use of property rental services provided by Prestige Homes. By engaging our services, contacting us for assistance, or using our website, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.
You must be at least 18 years old and have the legal capacity to enter into binding agreements to use our services.
2. Service Description
Prestige Homes provides property rental assistance services in Chiang Mai, Thailand. Our services include helping clients identify suitable rental properties, coordinating property viewings, facilitating communications with landlords, providing guidance on lease agreements, and offering various levels of support throughout the rental process as described in our service packages.
We act as an intermediary between clients and property owners. We do not own the properties we present and cannot guarantee the availability, condition, or suitability of any property.
3. Service Fees and Payment
Our service fees vary depending on the level of assistance you choose and are clearly stated during our initial consultation. Payment terms and methods will be agreed upon before services begin.
Service fees are separate from and in addition to any rental deposits, advance rent payments, or other costs associated with securing a property. You are responsible for all costs related to your rental agreement with the property owner.
All fees are stated in Thai Baht and are non-refundable once services have been initiated, except in cases where we are unable to provide the agreed-upon services due to circumstances within our control.
4. Client Responsibilities
As a client using our services, you agree to:
Provide accurate and complete information about your housing needs, budget, timeline, and any other relevant details that may affect the property search.
Communicate openly and promptly with our team regarding your preferences, concerns, and any changes to your requirements.
Conduct yourself professionally and respectfully during property viewings and in all interactions with landlords, property owners, and their representatives.
Review lease agreements carefully and seek legal counsel if needed before signing. While we provide guidance on standard lease terms, we are not legal advisors.
Fulfill all obligations under your rental lease agreement with the property owner.
5. Our Responsibilities and Limitations
We commit to providing professional, attentive service aimed at helping you find suitable rental accommodation. However, you acknowledge and accept that we cannot guarantee specific outcomes, such as finding a property within a particular timeframe or at a specific price point.
We make reasonable efforts to verify information about properties, but we rely on information provided by landlords and property owners. We are not responsible for inaccuracies in property descriptions or changes in property availability or condition.
We do not guarantee the suitability of any property for your specific needs or the behavior or reliability of landlords or property owners. You are responsible for conducting your own assessment of properties and making informed decisions.
6. Property Lease Agreements
Rental agreements are established directly between you and the property owner. Prestige Homes is not a party to these agreements and assumes no liability for disputes, breaches, or other issues arising from your rental arrangement.
While we can provide general information about typical lease terms and practices in Chiang Mai, we do not provide legal advice. We recommend consulting with a qualified legal professional for specific guidance on lease agreements and your rights and obligations as a tenant.
7. Intellectual Property
The content on our website, including text, graphics, logos, images, and software, is owned by or licensed to Prestige Homes and is protected by copyright and other intellectual property laws. You may view and use this content for personal, non-commercial purposes related to evaluating our services but may not reproduce, distribute, or create derivative works without our express written permission.
8. Limitation of Liability
To the maximum extent permitted by Thai law, Prestige Homes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or inability to use our services.
Our total liability for any claims arising from our services shall not exceed the amount of fees you have paid to us for those services.
This limitation of liability applies to claims based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
9. Indemnification
You agree to indemnify, defend, and hold harmless Prestige Homes, its owners, employees, and representatives from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services, your breach of these terms, or your violation of any rights of another party.
10. Privacy and Data Protection
Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to our privacy practices as described in that policy. Please review our Privacy Policy to understand how we handle your information.
11. Termination
Either party may terminate our service agreement at any time with written notice. Upon termination, you remain responsible for any fees for services already rendered. We will provide reasonable assistance with transition if termination occurs before completion of services.
We reserve the right to refuse or terminate services if you violate these terms, provide false information, or engage in behavior we deem inappropriate or harmful to our business or reputation.
12. Dispute Resolution
If any dispute arises regarding our services, we encourage you to contact us first to seek an informal resolution. We are committed to addressing concerns fairly and professionally.
If informal resolution is not possible, any disputes shall be governed by the laws of Thailand. You agree that the courts of Chiang Mai, Thailand, shall have jurisdiction over any disputes arising from these terms or our services.
13. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, civil unrest, pandemics, or other events that make it impossible or impractical to provide services.
14. Changes to Terms
We may update these Terms and Conditions periodically. Updated terms will be posted on our website with a revised effective date. Continued use of our services after changes constitutes acceptance of the updated terms. For significant changes, we will make reasonable efforts to notify clients directly.
15. Severability
If any provision of these terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Prestige Homes regarding our services and supersede any prior agreements or understandings.
